Procedure for appeal

  1. Any person aggrieved by the decision of Inspector of State Corporations can lodge their memoranda in writing, attaching copy(s) any relevant document(s) together with the assesed filing fees at the Tribunal’s registry. Separate grounds of appeal should be contained in separate paragraphs consecutively numbered. An Appeal must be filed within 30 days from the date of Surcharge decision.
  2. Parties to the an appeal may with the authority of the Tribunal amend their pleadings before commencement hearing.
  3. Pursuant to Order 5 of the civil procedure rules 2010, all filled documents must be served upon the interested parties.
  4. Appellant may withdraw his appeal by notice in writing to the Secretary.
  5. The parties reserves the right to appear in person or through representation. Where counsel is to appear on behalf of a party a notice of appointment will be filled at the Tribunal.
  6. Hearings are conducted in public unless a good cause to demonstrate need for camera hearings.
  7. The Chairman can cause witnesses including professional (opinion) witnesses to give evidence before the tribunal.
  8. Applications to the Tribunal be made by Chamber summons or Notice of motion supported by an affidavit.
  9. The tribunal to expeditiously hear and determine the appeal.

Where a party to a dispute is dissatisfied by the decision of the Tribunal, they have right of appeal to the High Court of Kenya, however, the decision of High Court is final and not subject for further appeal.
