State Corporation Appeals Tribunal

Background

State Corporations Appeal Tribunal was established in 1987 pursuant to section 22(1) of the State Corporations Act Cap. 446, to hear and determine appeals against the decision of the Inspector-General (Corporations). It commenced operations in 2000 when the Tribunal was set up having started receiving appeal cases from aggrieved persons who had been surcharged by the Inspector State Corporations as mentioned above. The Tribunal was established following an increase in cases of surcharge when the Government found it necessary to provide an avenue for redress to those who felt aggrieved by surcharges.  The Tribunal’s parent Ministry is the National Treasury.

Our Mandate

The Tribunal’s statutory mandate is captured under section 21(1) of the State Corporations Act, Cap 446, which empowers the Tribunal to hear and determine appeal from the decisions of the Inspector-General (Corporations) by any person aggrieved by a disallowance or a surcharge.  Section 21(2) of the Act empowers the Tribunal to upon hearing the appeal to confirm, vary or quash the decision of the Inspector-General (Corporations), and to remit the case to the Inspector-General (Corporations) with such directions as the Tribunal thinks fit for giving effect to the decision on appeal.

  • To promote alternative forms of dispute resolution, including reconciliation, mediation, arbitration and traditional dispute resolution mechanism
